Acceptance of Terms

By accessing or using the Peacock Wealth Management website (peacockwealthmanagement.com), engaging any of our advisory or financial services, submitting an enquiry form, using our financial calculators, or communicating with our team through any channel, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms apply to all visitors, users, and clients โ€” whether you are browsing our website as a prospective client, an existing client receiving advisory services, or a third party accessing our publicly available content.

If you are entering into these Terms on behalf of an entity (such as a company, HUF, or trust), you represent that you have the authority to bind that entity to these Terms, and references to "you" shall refer to that entity.

Our Services

Peacock Wealth Management is a SEBI-registered investment advisor providing the following categories of services to eligible clients in India:

  • Investment Advisory: Personalised investment advice, portfolio strategy, asset allocation recommendations, and periodic review services for individuals, families, and institutions.
  • Equity Advisory: Research-based equity investment recommendations across large, mid, and small-cap segments of the Indian equity market.
  • Mutual Fund Advisory: Fund selection, SIP structuring, portfolio rebalancing, and mutual fund investment guidance.
  • Portfolio Management Services (PMS) Advisory: Assistance with PMS provider selection, onboarding, performance monitoring, and rebalancing.
  • Financial Planning: Goal-based financial planning, retirement planning, insurance advisory, and wealth structuring services.
  • Educational Content: Market research reports, macroeconomic analyses, blog articles, financial calculators, and educational materials provided through our website and The Institute.
  • Ancillary Services: Demat account assistance, loan advisory, forex advisory, and other services as described on our website from time to time.

Service Availability: We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. Not all services may be available to all clients โ€” eligibility is subject to regulatory requirements, minimum investment thresholds, and our internal onboarding criteria.

Eligibility Requirements

To use our services, you must meet the following eligibility criteria:

  • You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher)
  • You must be a Resident Indian, Non-Resident Indian (NRI), Person of Indian Origin (PIO), or an eligible entity (HUF, company, trust, or partnership) under Indian law
  • You must have a valid PAN (Permanent Account Number) for investment and advisory services
  • You must complete our KYC (Know Your Customer) process as required by SEBI regulations before receiving advisory services
  • You must not be prohibited from receiving financial advisory services under any applicable law, regulation, or court order
  • For specific services (e.g., PMS), additional minimum investment thresholds and eligibility criteria apply as prescribed by SEBI

By engaging our services, you represent and warrant that you meet all applicable eligibility requirements. We reserve the right to refuse service to any individual or entity that does not meet our eligibility criteria or whose engagement would conflict with our regulatory obligations.

Section 04

The Advisory Relationship

Our advisory relationship with each client is governed by a separate Investment Advisory Agreement executed between the client and Peacock Wealth Management at the time of onboarding. These Terms supplement but do not replace the terms of that agreement.

Nature of Advisory Services
Investment advice provided by Peacock Wealth Management is based on information you provide to us and our analysis of market conditions at the time of advice. It is tailored to your specific financial situation, goals, and risk profile as disclosed by you. All advice is provided in good faith on the basis of information available at the time.

Client Responsibilities: To receive the best advisory outcome, you are responsible for:

  • Providing accurate, complete, and up-to-date information about your financial situation, goals, income, liabilities, and risk tolerance
  • Informing us promptly of any material changes to your financial circumstances, investment objectives, or personal situation
  • Reading all documentation, disclosures, and advisory agreements carefully before signing
  • Making your own informed decision to accept or reject any advisory recommendation โ€” we advise, but the final investment decision is always yours
  • Understanding the risks associated with any investment before proceeding

Suitability: We will only recommend investments that are suitable for you based on your risk profile, financial situation, and investment objectives as established during your onboarding. However, suitability assessments are based on information you provide โ€” if you provide inaccurate information, we cannot be held responsible for recommendations that may be based on that information.

Third-Party Products: Where we recommend third-party investment products (mutual funds, PMS providers, insurance products, etc.), our advisory fee is separate from any charges levied by the product provider. We will disclose all relevant conflicts of interest as required by SEBI regulations.

Fees & Payment

Our advisory fees are disclosed transparently in our fee schedule and in the Investment Advisory Agreement executed with each client. We operate on a fee-only basis โ€” our revenue comes entirely from advisory fees paid by clients, not from commissions or referral fees from product providers.

  • Fee Structure: Advisory fees may be structured as a fixed retainer, a percentage of Assets Under Advisory (AUA), or a combination of both, as agreed in writing in your advisory agreement.
  • Fee Disclosure: All fees are disclosed upfront and in writing before any advisory service commences. We will not charge any undisclosed fee without your prior written consent.
  • GST: All fees are subject to Goods and Services Tax (GST) at the applicable rate, which will be charged in addition to the advisory fee.
  • Payment Terms: Fees are payable as specified in your advisory agreement. Late payment may result in suspension of advisory services.
  • Refunds: Refund policies are governed by the terms of your individual advisory agreement. Generally, fees paid for services already rendered are non-refundable unless otherwise agreed in writing.
  • Fee Changes: We may revise our fee schedule with a minimum of 30 days' written notice to existing clients. Continued use of our services after the effective date of a fee change constitutes your acceptance of the revised fees.

SEBI Fee Cap: As a SEBI-registered investment advisor, our fees are subject to caps prescribed by SEBI regulations. We are compliant with all applicable fee regulations at all times. Our current fee schedule is available at /pricing.

Website Use

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use our website for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to:

  • Copy, reproduce, republish, or redistribute any content from our website without prior written permission
  • Use any data mining, robots, scraping, or similar data gathering tools on our website
  • Attempt to gain unauthorised access to any part of our website, servers, or systems
  • Use our website for any fraudulent, illegal, or unauthorised purpose
  • Post, upload, or transmit any malicious code, viruses, or harmful content

We reserve the right to terminate or restrict your access to our website at any time, without notice, for any reason โ€” including if we believe you are in breach of these Terms or any applicable law.

Financial Calculators: The financial calculators on our website (SIP, EMI, SWP, MTF, Step Up SIP, etc.) are provided as educational and planning tools only. Results are mathematical estimates based on user-entered assumptions and are not financial advice, investment recommendations, or guarantees of returns. Please read the disclaimer on each calculator page carefully.

Intellectual Property

All content on the Peacock Wealth Management website โ€” including but not limited to text, articles, research reports, market analyses, financial calculators, logos, graphics, images, videos, design elements, and the underlying code โ€” is the exclusive intellectual property of Peacock Wealth Management and is protected under Indian copyright law, trademark law, and other applicable intellectual property laws.

You may share links to our website and reference our publicly available content for non-commercial, educational purposes, provided you clearly attribute the content to Peacock Wealth Management and do not misrepresent it in any way.

Any commercial use, republication, or distribution of our content โ€” including our research reports, blog articles, and market analyses โ€” without our prior written consent is strictly prohibited and may result in legal action.

The Peacock Wealth Management name, logo, and brand identity are registered trademarks. Unauthorised use of our trademarks is prohibited.

You acknowledge that investment decisions involve risk and that you make all investment decisions at your own risk. Our advisory services reduce โ€” but cannot eliminate โ€” investment risk.

Limitation of Liability

To the fullest extent permitted by applicable Indian law, Peacock Wealth Management, its directors, officers, employees, agents, and advisors shall not be liable for:

  • Investment Losses: Any direct, indirect, consequential, or incidental financial losses arising from investment decisions made based on our advice, including losses resulting from adverse market movements, incorrect assumptions, or unforeseen economic events.
  • Indirect Losses: Any loss of profits, loss of business, loss of opportunity, or any other indirect or consequential loss, whether arising in contract, tort, or otherwise.
  • Information Accuracy: Losses arising from reliance on any information, content, or analysis that is subsequently found to be inaccurate, incomplete, or outdated.
  • Third-Party Actions: Actions or omissions of third-party service providers, brokers, depositories, fund managers, or other parties involved in the execution or management of your investments.
  • Force Majeure: Any losses resulting from events beyond our reasonable control, including market crashes, regulatory changes, natural disasters, government actions, or technological failures.
  • Website Downtime: Any losses arising from unavailability, errors, or interruptions to our website or online services.

Maximum Liability: Where liability cannot be excluded entirely under applicable law, our total aggregate liability to you in connection with our services shall not exceed the total fees paid by you to Peacock Wealth Management in the 12-month period immediately preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded or limited under applicable Indian law.

Indemnification

You agree to indemnify, defend, and hold harmless Peacock Wealth Management and its directors, officers, employees, agents, and advisors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • Your breach of any provision of these Terms
  • Your use of our website or services in violation of any applicable law or regulation
  • Your violation of the rights of any third party, including intellectual property rights
  • Any inaccurate, false, or misleading information you have provided to us in the course of engaging our services
  • Any claim arising from your failure to comply with applicable KYC, AML, or other regulatory requirements
Section 11

Termination of Services

Either party may terminate the advisory relationship at any time, subject to the notice provisions in your individual advisory agreement. Termination of the advisory relationship does not affect any rights or obligations that have accrued prior to the date of termination.

  • Termination by You: You may terminate your advisory relationship with us by providing written notice as specified in your advisory agreement. Any fees due for services rendered up to the termination date remain payable.
  • Termination by Us: We may terminate our advisory relationship with you immediately if: you breach any material term of these Terms or your advisory agreement; you provide false or misleading information; you fail to pay fees as agreed; your engagement would cause us to violate any law or regulation; or your conduct is abusive toward our staff.
  • Effect of Termination: Upon termination, we will cease providing advisory services. Your existing investments will remain in your name and under your sole control. We will provide a final report and handover documentation as required by SEBI regulations.
  • Survival: Provisions relating to intellectual property, liability limitations, indemnification, governing law, and dispute resolution shall survive termination of these Terms.
Section 12

Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The courts of Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms or your use of our services.

Dispute Resolution Process: Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through the following steps:

  1. Informal Resolution: The aggrieved party notifies the other party in writing, and both parties attempt in good faith to resolve the dispute within 15 business days.
  2. Grievance Mechanism: If informal resolution fails, disputes may be escalated through our formal grievance redressal mechanism as described in our Grievance Policy.
  3. SEBI SCORES: Regulatory disputes may be escalated to SEBI via the SCORES portal at scores.sebi.gov.in.
  4. SEBI Smart ODR: Disputes may be submitted to SEBI's Online Dispute Resolution platform at smartodr.in for independent conciliation or arbitration.
  5. Legal Proceedings: If all other mechanisms are exhausted, disputes may be brought before the courts of Chennai, Tamil Nadu, India.

Changes to These Terms

We reserve the right to modify these Terms at any time to reflect changes in our services, applicable laws and regulations, or our business practices. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify existing clients by email where changes materially affect their advisory relationship with us
  • Post a prominent notice on our website for a reasonable period following any material update

Your continued use of our website or services after any amendments to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should cease using our services and notify us in writing of your intention to terminate your advisory relationship.
